Terms of Service

These govern your use of platform1hq.com, the P1 Index assessment, and any free material we send you. Paid engagements are governed by a separate signed agreement, which takes priority over anything here.

1. Accepting these terms

By using this site, completing the P1 Index, or submitting a form, you accept these terms. If you do not accept them, do not use the site. You confirm you are at least 18 and, where you act for a company, that you are authorised to do so.

2. What we provide

Platform One provides business diagnostic and advisory services. We assess a company across five sectors, identify the constraint most likely limiting it, and advise on what to do about it. Free material on this site, including the P1 Index and our emails, is educational.

3. What this is not

Read this section even if you skip the rest.

We are not your investment adviser. Platform One does not provide investment advice, does not recommend securities, does not manage money, and does not offer or sell securities. Nothing on this site or in our emails is an offer, solicitation, or recommendation to buy or sell any security or investment.

Nick Ayala separately holds Series 65 and 63 registrations and is involved in other ventures. Those are disclosed on this site as background. They are not the capacity in which Platform One engages you, and no advisory relationship of that kind is created by using this site, completing the assessment, or engaging Platform One.

We are not lawyers, accountants or tax advisers. Nothing here is legal, accounting, or tax advice. Get your own professionals for those.

Using this site does not create a client relationship. That begins only when both sides sign an engagement agreement.

4. The P1 Index

The P1 Index is a free, self-scored questionnaire. It reflects your own answers about your own business, given at one moment in time, and nothing else. We say so plainly on the result itself.

The pattern we describe for each revenue band is what we commonly observe. It is not a statistical claim, a study, or a prediction about you.

5. Paid engagements

Paid work is governed by a separate written agreement covering scope, fees, timing and deliverables. Where that agreement conflicts with these terms, that agreement wins. Fees quoted on a call or in a proposal are valid only as stated in that proposal.

7. Intellectual property

The P1 Method, the P1 Index, the five-sector framework, the Baseline instrument, our written material, and everything on this site belong to Platform One or to Nick Ayala.

You may read it, and you may use it inside your own business. You may not republish it, sell it, or present it as your own work. Deliverables produced during a paid engagement are licensed to you for use in your business; the underlying methods and templates remain ours.

8. Confidentiality

What you tell us about your business, including your assessment answers and anything shared during an engagement, is treated as confidential. We do not disclose it except to the service providers listed in our privacy policy, or where the law requires it.

Where we describe client outcomes publicly, we do so anonymously unless that client has given written permission to be named.

9. Liability

To the fullest extent the law allows:

Nothing here limits liability for fraud, or for anything that cannot lawfully be limited.

10. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in the State of Wyoming, and both sides consent to that jurisdiction.

Before filing anything, both sides agree to try to resolve the matter in good faith by talking, within 30 days of written notice.

11. Changes

We may update these terms. The date below shows the current version, and continuing to use the site after a change means you accept it.
